BOEM Proposed Rule Change – Financial Assurance for Offshore Oil & Gas

The Bureau of Ocean Energy Management (BOEM) has proposed a significant revision to its offshore financial assurance framework, effectively reversing key elements of the 2024 Final Rule. The proposed changes are designed to reduce capital constraints on operators while maintaining taxpayer protection through structural safeguards such as joint and several liability.

For offshore operators, this represents a meaningful shift: less required collateral, greater reliance on credit quality and predecessor strength, and increased flexibility in how financial assurance obligations are satisfied.
